Mississippi County Agrees to Voter Roll Cleanup Plan

Consent Decree Addresses Noxubee County’s Corrupted Voter Records
(JACKSON, MS.) – January 25, 2017: The Public Interest Legal Foundation (PILF) today announced a consent decree between its client, the American Civil Rights Union, and the Noxubee County, MS, Election Commission to enforce obligations to maintain voter rolls according to the National Voter Registration Act.
“After years of living under corrupted voter rolls, Noxubee County residents can begin to feel assured that a course correction is underway,” PILF President and General Counsel J. Christian Adams said. “This agreement should help inspire confidence that each vote will enjoy its full weight and value and diminish the risk of fraudulent elections.”
The consent decree, which will remain in effect until February 1, 2018, requires the following actions agreed to by the parties which follow existing Mississippi Secretary of State maintenance directives:
Continue to identify dead voters on the rolls. The County will follow procedures requiring the use of Mississippi Department of Health records to identify dead voters listed, regardless of registration status.
All registered voters failing to cast a ballot since January 2011 will be subject to a mailing effort. The forwardable mail will instruct recipients to list their current address. Failure to do so will result in removal if they fail to vote in the 2018 and 2020 federal elections thereafter.
Former residents must be scrubbed from the lists. County agrees to utilize voter registration mailers, jury summons responses, and out-of-jurisdiction homestead exemptions to identify and remove voters that have moved out of Noxubee.
Voters relocating in and out of County will be tracked. County agrees to use the U.S. Postal Service National Change of Address system to keep records updated.
Progress reports will be provided to Plaintiff. By September 2018, Noxubee County will outline the number of ineligible, relocated, inactivated, and removed voters according to the consent decree. The County agrees to retain maintenance records generated for future inspection.
Prior to the suit, Noxubee County exhibited voter registration rates well beyond 100 percent in the 2010, 2012, and 2014 federal elections. PILF previously noted that the County has a history of systemic and widespread voter fraud, acknowledged by the U.S. District Court in Mississippi.
The Noxubee County Election Commission voted in favor of the terms on January 20. The suit was originally filed in November 2015. For additional court documents, click here.
