New Mexico Withholds Files of Wrongful Voter Roll Purges Using ERIC Data

(Alexandria, VA) June 3, 2026 — The Public Interest Legal Foundation (PILF) filed a federal lawsuit against New Mexico Secretary of State Maggie Toulouse Oliver for violations of the National Voter Registration Act of 1993 (NVRA), commonly known as “Motor Voter.” The State is denying access to data, which would reveal how many times the Electronic Registration Information Center (ERIC) had to correct maintenance leads which caused live New Mexicans to be cancelled from the voter roll after being flagged as deceased.  

PILF requested “Deceased Retractions” reports supplied by ERIC to New Mexico. This comes after legal victories against Oregon and Arizona for similar records. After PILF sued, both states conceded and agreed to produce the records going forward.  

“New Mexico’s refusal to provide these records prevents the public from knowing whether voters were wrongly removed as deceased. In some cases, this results in eligible citizens encountering issues when they attempt to vote,” said PILF President, J. Christian Adams. “By denying access to ERIC’s records in New Mexico, they’re violating the NVRA, which Congress put in place to mandate transparency in voter roll maintenance and hold election officials accountable.”
