PILF Wins Agreement from New Mexico to Disclose Dead Voter Reports

ALEXANDRIA, VA (July 15, 2026) –The Public Interest Legal Foundation (PILF) won a victory by requiring New Mexico Secretary of State Maggie Toulouse Oliver to disclose to the public Electronic Registration Information Center (ERIC) retraction reports. These reports reveal mistakes by ERIC regarding which registrants on the active rolls are dead. (Public Interest Legal Foundation v. Toulouse Oliver No.1:26-CV-01773)

Under the settlement, Secretary Toulouse Oliver must maintain the reports about deceased voters and mistakes made for two years and make them publicly available when requested. 

“This settlement is a win for New Mexico voters,” said PILF President and General Counsel J. Christian Adams. “The dead should not be on the rolls, and the living should not be removed as dead. ERIC makes mistakes on both counts. The public has a right to know about the mistakes. Federal law requires public access to voter roll maintenance records, which is one of the most effective ways to identify potential errors.”

PILF also collected attorney’s fees in the case, underscoring the cost of wrongly denying access to federally mandated voter roll maintenance records. PILF reached similar settlements in Arizona and Oregon.
